1. Acceptance of Terms

By accessing or using the YoCheckIn platform and website (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, then you may not access the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

YoCheckIn provides a Software-as-a-Service (SaaS) solution designed for salons and businesses to manage appointments, staff, client databases, and marketing campaigns (SMS, WhatsApp, Email). The Service is provided subject to the subscription plan you select.

3. User Accounts & Responsibilities

• You must provide accurate, complete, and current registration information.
• You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
• You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Payments, Billing, and Subscriptions

Subscriptions: Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (monthly).

Payment Processors: We use Mollie to process payments securely. By providing your payment information, you authorize us and Mollie to charge all Subscription fees incurred through your account.

Refunds: Except when required by law (such as the EU 14-day cooling-off period where applicable), paid Subscription fees are non-refundable.

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of YoCheckIn and its licensors. The Service is protected by copyright, trademark, and other laws of Spain and foreign countries.

6. User Content and Conduct

You retain any and all of your rights to any content or client data you submit, post or display on or through the Service ("User Content"). You are solely responsible for the legality, reliability, and appropriateness of this data.

You agree not to use the Service (including our SMS and Email Marketing gateways) to send spam, unsolicited messages, or any content that violates applicable laws.

7. Limitation of Liability

In no event shall YoCheckIn, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service.

8. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Spain and the European Union, without regard to its conflict of law provisions. Any disputes arising out of these Terms will be subject to the exclusive jurisdiction of the courts located in Barcelona, Spain.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
